Senate Passes “Made In America” Bill

In a 36-1 vote, the New Jersey Senate passed S-1811 which would place a mandate on a vendors doing work with the State of New Jersey to purchase materials and products that are made in America, when servicing state contracts.  Vendors can apply for a waiver if the costs of the materials exceed 20% of fair market value or if supply cannot satisfy contract requirements.  Additionally, certain products are exempt from the legislation including products and materials related to the information technologies & telecommunications industries, and products receiving approval from the United States Food & Drug Administration (USFDA).  While the amendments eased the impact of the bill, many business associations, including the Commerce and Industry Association of New Jersey (CIANJ) opposed the bill expressing concerns with restricting free trade and the chilling effect it may have on foreign investment in the State.
